Terms of Service
These terms govern the use of this website and the transportation services Cargo Taxi Deliveries provides. Booking a shipment, requesting a quote, or signing a document sent from this site means accepting them.
Nothing here reduces a right you have under the federal law governing interstate motor carriage, under California law, or under a separate written agreement signed between us. Where a signed agreement and these terms disagree, the signed agreement governs.
1.Who we are
Cargo Taxi Deliveries is a motor carrier based in Los Angeles, California, operating under US DOT 2339618, MC 798866 and California number 431775. We are an asset-based carrier: we own the vehicles and employ the drivers. We are not a freight broker and we do not re-sell other carriers' capacity without telling you.
2.Quotes and estimates
A price shown by the online estimator, or given verbally, is an estimate based on the information supplied at the time. It is not a binding offer. The final price is confirmed by dispatch, normally within one business hour, and once confirmed in writing it is the price — we do not revise a confirmed price for a job that runs as described.
A price will change when the job is not as described: more weight than stated, more pieces, a dock that turns out not to exist, an access restriction not mentioned, a delivery window that was not disclosed, or a commodity that is regulated and was not declared. In every such case we tell you before the additional charge is incurred wherever it is practical to do so.
3.Booking and cancellation
A booking is made when dispatch confirms it. Until then, nothing is reserved.
A booking cancelled before a driver has been dispatched is not charged. A booking cancelled after dispatch, or where a driver arrives and the freight is not ready or not available, is charged a dry-run fee reflecting the vehicle and driver time committed. Expedited bookings commit a vehicle immediately and are charged from the moment of confirmation.
4.Your responsibilities as shipper
Freight must be packaged adequately for commercial transport. We are not responsible for damage arising from inadequate packaging, from goods loaded by you in a manner we could not inspect, or from an inherent defect in the goods themselves.
- Describe the freight accurately, including weight, piece count and dimensions.
- Declare anything regulated — hazardous materials, lithium batteries, controlled substances, firearms — before the vehicle is dispatched.
- Supply correct and complete shipping papers, including a proper shipping name and UN number where the commodity is regulated.
- Disclose access conditions at both ends: dock, forklift, stairs, parking, receiving hours and appointment requirements.
- State any temperature requirement on the bill of lading, not only in correspondence.
- Ensure someone is present to tender and to receive the freight within the agreed window.
5.Hazardous materials
We carry hazardous materials only where we hold the applicable authority and the driver holds a current endorsement. Classification, packaging, marking, labelling and the accuracy of the shipping paper are the shipper's legal responsibility under 49 CFR Parts 171 to 180, and remain so regardless of our experience with the commodity.
We will refuse any load we believe to be misdeclared, and we will refuse classes for which we do not hold authority. Undeclared hazardous material discovered in a shipment may be returned or surrendered to the appropriate authority at the shipper's cost, and the shipper is responsible for any resulting loss, fine or clean-up.
6.Liability for loss and damage
Our liability for loss of or damage to freight is governed by the applicable federal law for interstate shipments and by California law for intrastate shipments, and is limited to a released value unless a higher value is declared in writing before the shipment moves and the applicable additional charge is paid.
The released value limit, the declared value option and the additional charge are stated on request and on the bill of lading. We encourage any shipper whose freight is worth materially more than its weight suggests to declare a value: a pallet of electronics covered at a per-pound released rate is, in practice, barely covered at all.
We are not liable for consequential, indirect, special or punitive damages, including lost profits, production stoppage, or charges levied on you by a third party as a result of a delay, except where such liability cannot be excluded by law.
7.Claims
Visible loss or damage must be noted on the delivery receipt before the driver leaves. Concealed damage must be reported within fifteen days of delivery. A written claim must be filed within nine months of delivery, or within nine months of the date delivery should have occurred, and any suit must be brought within two years and one day of our written declination of a claim.
A claim must identify the shipment, state the amount claimed, and be accompanied by the bill of lading, the delivery receipt, a repair estimate or invoice evidencing value, and photographs where damage is alleged. We acknowledge claims within thirty days and resolve them as promptly as the evidence allows.
8.Delivery windows and delay
Transit times quoted are estimates in good faith based on normal conditions. We do not guarantee a delivery time unless we have agreed a guaranteed window in writing, and where we have, the remedy for missing it is the one stated in that agreement.
We are not liable for delay caused by matters outside our reasonable control, including weather, road or pass closure, traffic, a closed or unstaffed receiving location, an appointment system, customs or regulatory hold, labour action, mechanical failure, or an act of a public authority.
9.Detention, waiting time and accessorials
A free loading and unloading period applies at each stop. Waiting beyond it is charged by the hour at the rate current at the time of booking, pro-rated. Accessorial charges — liftgate, inside delivery, residential delivery, two-person handling, temperature control, re-delivery and others — are charged as quoted, and we state them before performing the work wherever it is practical.
10.Payment
Unless credit terms have been agreed in writing, payment is due on delivery. Where credit terms apply, invoices are due net thirty days from the invoice date. Overdue amounts may attract interest at the maximum rate permitted by law, and we may suspend service on an account that is materially overdue.
We have a lien on freight in our possession for charges due on that shipment, as provided by law.
11.Documents signed electronically
Estimates, invoices and agreements sent from this site may be signed electronically. Under the federal E-SIGN Act and the California Uniform Electronic Transactions Act, an electronic signature carries the same legal effect as a signature in ink.
Signing is voluntary: a paper copy can be requested at any time at no charge by contacting us, and a request for paper does not disadvantage the request in any way. A signing link is private to its recipient, is not indexed by search engines, and should not be forwarded to anyone who is not authorised to sign.
We record the date and time of signature, the signer's name as entered, and a cryptographic fingerprint of the document as it stood when it was signed — so that a document altered after signing can be identified as such.
12.Using this website
The content of this site, including the service descriptions, the knowledge articles and the rate structure, belongs to Cargo Taxi Deliveries. You may read it, quote it with attribution, and link to it freely. You may not misrepresent it as your own, nor use it to imply an affiliation that does not exist.
The quote estimator is provided for convenience. We make no warranty that it is free of error, and an estimate produced by it does not bind us.
13.Governing law
These terms are governed by the law of the State of California and, where it applies, by federal law governing interstate motor carriage. Any dispute not resolved between us will be heard in the state or federal courts located in Los Angeles County, California, and both parties submit to that jurisdiction.
14.Changes to these terms
We may update these terms. The version in force for any shipment is the version published on the date the booking was confirmed, and the date at the top of this page says when it last changed. Material changes do not apply retroactively to shipments already booked.
